General Terms of Use
These General Terms and Conditions define the terms for the provision of services on the www.foapi.org website, hereinafter referred to as ‘the Service’, and the conditions for the User’s use of the Service. Any access to and/or Use of www.foapi.org implies the acceptance and observance of all the terms of these Conditions and their unconditional acceptance. They therefore constitute a contract between the FOAPI organizers and the User. Should the User not wish to accept all or part of these general terms and conditions, they are requested to cease all use of the Service.
Definitions
- User: refers to any person who uses the Site or any of the services offered on the Site.
- User Content: refers to data transmitted by the User in the various sections of the Site.
- Member: refers to a user identified on the site.
- Login: The term “Login” covers the information required to identify a user on the site to access areas reserved for members.
- Password: The “Password” is confidential information that the User must keep secret, allowing them, when used in conjunction with their Login, to prove their identity.
Access to the Service
The Service is accessible free of charge to any User with internet access. All costs related to accessing the Service, whether hardware, software, or internet access fees, are exclusively borne by the User. The User is solely responsible for the proper functioning of their computer equipment and their internet access. Certain sections of the site are reserved for Members after identification using their Login and Password.
The FOAPI organizers reserve the right to refuse access to the Service, unilaterally and without prior notification, to any User who does not comply with these terms of use. The FOAPI organizers implement all reasonable means at their disposal to ensure quality access to the Service but are not bound by any obligation to achieve this. Furthermore, the FOAPI organizers cannot be held responsible for any network or server malfunction or any other event beyond reasonable control that would prevent or degrade access to the Service. The FOAPI organizers reserve the right to interrupt, temporarily suspend, or modify access to all or part of the Service without prior notice or notification, in order to ensure its maintenance, or for any other reason, without such interruption giving rise to any obligation or compensation.
Personal Data
The FOAPI organizers comply with legal provisions regarding personal data, particularly Ivorian Law No. 2013-450 of June 19, 2013, relating to the protection of personal data. Users may provide personal data concerning them to the organizers by completing forms or questionnaires on this site. This data will be used for the following purposes: processing information requests, compiling statistics, for commercial prospecting purposes, and for the execution of applicable legal, regulatory, and administrative provisions.
In accordance with applicable regulations, any prospecting by automated call, email, SMS, MMS, or fax, as well as any transfer or rental of data for prospecting purposes using these means, will only be carried out with the User’s prior consent to receive prospecting via this channel and/or to the transfer of their data. If the User agrees to receive such prospecting messages by checking the acceptance boxes provided for this purpose on this site, they may withdraw this consent at any time.
At any time and free of charge, the User may object to any prospecting by other means by writing to FOAPI Abidjan Plateau Immeuble MACI 17ème étage, Côte d’Ivoire. The personal data collected is intended exclusively for the use of FOAPI, its subsidiaries, its foundations, and its service providers, where applicable. It will therefore, under no circumstances, be made available to third parties. However, FOAPI reserves the right to transmit the personal data of any User in order to fulfill its legal obligations.
FOAPI may transfer the personal data collected to its constituent entities, namely (Fondation Atlantic Group, Fondation BOAD, Fondation Future Africa), as well as to its service providers established outside Côte d’Ivoire. These data transfers occur under conditions and guarantees designed to ensure the protection of Users’ personal data. FOAPI implements all necessary technical and organizational measures to guarantee the security and confidentiality of the personal data collected and processed. Every User has a right to access their personal data, to rectification, and to object under the conditions provided by applicable regulations.
Hyperlinks
This site notably contains information made available by external companies or hyperlinks to other sites that have not been developed by FOAPI. The existence, on this site, of a hyperlink leading to another site does not constitute validation of that other site or its content. FOAPI therefore assumes no responsibility for these sites, their content, advertisements, products, or services available on or from these sites.
Intellectual Property Rights
The general structure, texts, animated or still images, and all elements composing this website are the property of FOAPI, or have been acquired from third parties for use on the Internet or other media and cannot be used without FOAPI’s authorization. Any total or partial reproduction of this site or any of its elements without the express prior authorization of FOAPI is prohibited. The FOAPI logos and trademarks appearing on this site are registered trademarks. Any total or partial reproduction of these trademarks and logos for any purpose whatsoever, and notably for advertising purposes, made from the elements of this site without the written consent of the trademark owner is prohibited.
Limits of Liability
The information made available on this site is for informational purposes only and cannot under any circumstances constitute advice or a recommendation of any kind. Consequently, the Use of information and content available throughout the site cannot under any circumstances engage FOAPI’s liability. The User is solely responsible for the proper use, with discernment and judgment, of the information made available on the Site.
Furthermore, the User undertakes to indemnify FOAPI for all harmful consequences directly or indirectly related to their use of the Service. Access to certain sections of the www.foapi.org site requires the use of a Login and a Password. The Password, chosen by the user, is personal and confidential. The user undertakes to keep their password secret and not to disclose it in any form whatsoever.
FOAPI nevertheless undertakes to implement all necessary means to guarantee the security and confidentiality of the data collected. The User is informed that one or more cookies, containing no personal information, may be placed on their hard drive to ensure their identification. FOAPI cannot, under any circumstances, within the limits of applicable law, be held responsible for damages and/or prejudices, direct or indirect, material or immaterial, or of any nature whatsoever, resulting from an unavailability of the Service or any Use of the Service.
Force Majeure
FOAPI’s liability cannot be engaged in cases of force majeure or events beyond its control.
Evolution of this Contract
FOAPI reserves the right to modify the terms, conditions, and provisions of this contract at any time. The User is therefore advised to regularly consult the latest version of the Terms of Use available on the www.foapi.org website.
Duration and Termination
This contract is concluded for an indefinite period from the User’s Use of the Service.
Applicable Law and Competent Jurisdiction
The rules of law applicable to content and data transmissions on and around the site are determined by Ivorian law. In the event of a dispute that could not be settled amicably, only the Ivorian courts within the jurisdiction of the Abidjan Court of Appeal are competent.
